Abstract

This study aims to determine domestic violence in the perspective of Islamic law related to the emergence of domestic violence often due to misunderstanding between husband and wife. If this is not immediately resolved, it will lead to domestic violence. The method used by researchers is descriptive research with a juridical-empirical approach is research that examines positive legal rules in order to get answers to existing problems by linking with facts or henomena. the phenomenon of Domestic Violence in order to fulfill scientific prerequisites because they want to analyze and know about domestic violence according to the perspective of Islamic law and the factors that influence it. Research Location This research was conducted at the Makassar Religious Court, with the consideration that there are still many cases of violence committed by husbands against wives in this area, both those that have been reported and those that have not been reported, so that law enforcement is considered important and urgent. Likewise, the provision of criminal sanctions for husbands who commit violence against wives in the family, has not been fully implemented in a maximum and consistent manner. The results showed that Islamic teachings explicitly forbid domestic violence, especially Muslims, this is evidenced by many verses in the Koran and hadiths that instruct par husbands to treat their wives with good relationships, facts in society about the form of domestic violence show that the size or seriousness of the act of domestic violence is not always parallel and balanced with the level of protest and criticism carried out.
