Abstract

This study aims to find out and analyze the basis of judges' considerations in making verstek decisions and to find out and analyze legal remedies against verstek decisions. This research uses the normative method. The types and sources of data used are primary data and secondary data. The technique of collecting legal materials is carried out by observing the sources of legal materials related to this research study. The results of the study show that the basis for the judge's consideration of the Verstek decision on the case in Decision Number 498/Pdt.G/2019/PN.Mks is because the Defendant has been summoned five times in a row and has never been present at the trial even though he has been legally and properly summoned and Efforts against the verstek decision can be made by means of resistance/verzet. If a verstek decision is handed down against the defendant, and the defendant objects to it, the defendant can file a fight
